The Supreme Administrative Court did not overrule HKL’s decision to cancel the procurement decision of November 26, 2015 awarded to Innofactor in a bidding competition concerning situational information system for the Metro’s total security

As Innofactor has informed in its earlier stock exchange release of January 28, 2016 at 08:40 Finnish time, Innofactor Software Oy (part of Innofactor Group) has initiated legal proceedings demanding the cancellation of a decision of the Board of HKL (Helsinki City Transport). The referred HKL decision given January 27, 2016 cancelled HKL’s earlier decision where Innofactor was selected as supplier of the situational information system for the Helsinki Metro’s total security. The cancellation was based on Tieto Finland Oy’s, which came third in bidding competition, claim for rectification. The framework arrangement of the procurement was intended to remain in effect for a maximum of 15 years. For this total time, Innofactor had stated that the total price according to the tender would have been EUR 7,025,500.

The Supreme Administrative Court of Finland (KHO) has given its final decision on the matter on March 2, 2018. KHO has is its decision maintained the former decision of the Market Court rejecting Innofactor’s appeal. KHO’s grounds for the decision differ from those of the Market Court in determining which parts of the information given regarding the merits of the agile team experts were intended to be taken in to account in the actual comparison of the bidders confirming Innofactor’s respective representation in its appeal. KHO has not, however, seen that HKL would have acted against legal regulations for public procurement when cancelling the already made procurement decision where Innofactor was selected.
